Privacy Policy

This privacy statement describes how truthlab Technologies, Inc. (“truthlab”) collects, secures, and uses the personal information and data you provide through our services. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. We will share your personal information with third parties only in the ways that are described in this privacy statement. The use of information collected through our service shall be limited to the purpose of providing the service for which the Customer has engaged truthlab.

This privacy policy applies to all products, services and websites offered by truthlab, except where otherwise noted. We refer to those products, services and websites collectively as the “services” in this policy. Some services have supplementary privacy statements that explain in more detail our specific privacy practices in relation to them. Unless otherwise noted, our services are provided by truthlab (collectively, “truthlab”, “We”, “Our” or “Us”).

truthlab is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.  truthlab complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, truthlab is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.  In certain situations, truthlab may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website [https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint], you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

Information we collect

We collect the following personal information from our Customers:

Information we collect directly from you

  • Account information. When we create your account, we collect your username, password, email address, first name, last name and title. When you add new users to your account, we collect the same information for all the additional users.
  • Account settings. You can set default preferences in your account.
  • Survey data. We store your study data (questions, responses and data) for you.
  • Other data you intentionally share. We may collect your personal information or data if you submit it to us in other contexts.

Information we collect about you from other sources

  • Usage data. We collect usage data about you whenever you interact with our services. This may include which webpages you visit, what you click on, when you performed those actions, and so on. Additionally, like most websites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses.
  • Device data. We collect data from the device and application you use to access our services, such as your IP address and browser type. We may also infer your geographic location based on your IP address.
  • Referral data. If you arrive at a truthlab website from an external source (such as a link on another website or in an email), we record information about the source that referred you to us.
  • Information from page tags. We use third party tracking services that employ cookies and page tags (also known as web beacons) to collect data about visitors to our websites. This data includes usage and user statistics.

When you download and use our Services, we automatically collect information on the type dof device you use, operating system version, and the device identifier (or “UDID”). We collect your location-based information for purposes of providing the services hereunder to you (which may include the improvement of such services and our provision thereof). We will only share this information with our mapping provider for the sole purpose of providing you the services hereunder.

How we use your personal information

We treat your study questions, responses and data as information that is private to you. We do not sell your survey data to third parties.

We use the information we collect from you in connection with providing our services to you.

  • To provide you with our services.
    1. This includes providing you with customer support, which requires us to access your information to assist you (such as with study design and creation or technical troubleshooting).
  • To manage our services. We internally use your information for the following limited purposes:
    1. To monitor and improve our services and features. We internally perform statistical and other analysis on information we collect (including usage data, device data, referral data, and information from page tags) to analyze and measure user behavior and trends, to understand how people use our services, and to monitor, troubleshoot and improve our services.
    2. To assist the enforcement of our Terms of Use.
    3. To prevent potentially illegal activities.
    4. To screen for undesirable or abusive activity.
  • To create new services and features.
  • To contact you about your service or account. We occasionally send you communications (e.g. service-related announcements, billing-related matters, changes to our services or policies, a welcome email when you first register). You can’t opt out of these communications since they are required to provide our services to you.
  • To contact you for marketing purposes (if you opt in).

Communications from the site

Newsletters

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. If you wish to no longer receive these emails you may follow the unsubscribe instructions contained in each of the email communications you receive.

Service-related announcements

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

Service providers

We use other third parties such as an email service provider to send out emails on our behalf. When you sign up for our services, we will share your personal information only as necessary for the third party to provide that service.

We use this information to administer our Customers’ truthlab account.

truthlab collects information under the direction of its Customers, and has no direct relationship with the individuals whose personal data it processes. If you are a customer of one of our Customers and would no longer like to be contacted by one of our Customers that use our service, please contact the Customer that you interact with directly. truthlab works with its Customers to help them provide notice to their customers concerning, the purpose for which personal information is collected. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Customers.

Choice

truthlab acknowledges that you have the right to access your personal information.   truthlab has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the truthlab‘s Customer (the data controller). If the Customer requests truthlab to remove the data, we will respond to their request within 30 days.

Sharing of information

We will share your personal information with third parties only in the ways that are described in this privacy statement.

We reserve the right to disclose your personally identifiable information as required by law, in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our web site, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request and to any other third party without your prior consent to do so.

If truthlab is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Service providers

truthlab may transfer personal information to companies that help us provide our service such as third parties who assist us in recruiting panels for our Customers. Transfers to these third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Customers.

Data retention

truthlab will retain personal data we process on behalf of our Customers for as long as needed provide services to our Customer. truthlab will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Access to personally identifiable information

Upon request truthlab will provide you with information about whether we hold any of your personal information. If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete/deactivate it by emailing our legal team at legal@truthlab.com. We will respond to your request within a reasonable timeframe.

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Security

The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. When you enter sensitive information (such as login credentials) on our forms, we encrypt the transmission of that information using secure socket layer technology (SSL). No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Tracking technologies

truthlab and its partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies on an individual as well as aggregated basis, for purposes of providing the services hereunder to you, to improve such services and our provision thereof, and/or improving our customers’ (including your) overall experience and engagement with our services.

We use cookies to remember users’ settings (e.g. language preference), for authentication. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.

Log files

As is true of most web sites, we use a third party tracking-utility partner gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

Information we collect

When you use truthlab, we collect information relating to you and your participation in our studies from a variety of sources:

  • Study responses. We collect and store the responses that you submit when you participate in a study, which may include screenshots and screencasts as well as audio and/or video recordings made using your webcam during your participation in a study (but only with your consent, which is provided by responding affirmatively when the study asks you for permission to record such audio and/or video). The Study Creator is responsible for this data and manages it. A study (i.e., study) may ask you to provide personal information or data. If you have any questions about a study you are taking, please contact us. The Study Creator sometimes has its own privacy statement, as we are not responsible for the content of the studies they create.
  • Usage data. We collect usage data about you whenever you interact with our services. This may include which web pages (i.e., URLs) you visit, what you click on, when you performed those actions, and so on. Additionally, like most web sites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses.
  • Device data. We collect data from the device and application you use to access our services, such as your IP address and browser type. We may also infer your geographic location based on your IP address. As mentioned above, our mobile application may also request access to your device’s camera and microphone sensor in connection with your participation in certain study(s) that record study participants’ voice, face, and/or computer screen.
  • Referral data. If you arrive at a truthlab web site from an external source (such as a link on another web site or in an email), we record information about the source that referred you to us, as well as whatever information that site chose to encode in the URL.
  • Information from page tags. We use third party tracking services that employ cookies and page tags (also known as web beacons) to collect data about visitors to our web sites. This data includes usage and user statistics.
  • Name and contact details. We collect your name and contact details you may provide when registering, downloading and/or using our platform or contacting us to request support, ask questions, make a request or complaint.
  • If you respond affirmatively when our truthlab application asks for permission to collect and use geolocation information, precise geolocation is transmitted directly from the application to the Study Creator. We collect your location-based information for purposes of the applicable study, providing usage data to the Study Creator, and/or providing you with the services hereunder. We will only share this information with our mapping provider for the sole purpose of providing you the services hereunder.

When you download and use our Study Tool, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”).

We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from.

We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.

Providing study responses is voluntary

Remember, you can always choose not to provide an answer to any given study question (especially those requesting your personal information or data). However, sometimes this will prevent you from completing a study if the Study Creator has marked that question as requiring an answer.

How we use your personal information

truthlab will use your study responses for the sole purpose of carrying out the research our Customers have commissioned. Your participation in this research, together with your individual responses to the questions will be kept strictly confidential by us, such as statistical information only. We will only seek your consent where it is necessary for the relevant research and seeking your consent to disclosing identifiable responses is permitted by applicable data privacy laws and national market research rules.

truthlab will share your personal information with third parties only in the ways that are described in this privacy statement. truthlab does not sell study responses to third parties.

We may use your personal information to send you service announcements or to respond to any communication you send to us. We may also use the information we collect from you (including usage data, device data, referral data and information from page tags) to manage and improve our services.

To whom we may disclose your personal information

Access to your information will be limited to only those truthlab staff involved in the applicable study, or who need access in order to directly support our systems, such as our operations and IT staff. This may include staff of:

  • Other truthlab affiliated companies who provide processing services for and on behalf of, and under the control of truthlab.
  • Our sub-contractors who carry out data processing; including the service providers who host or provide technical support for our systems.

These companies are authorized to use your personal information only as necessary to provide these services to us.

  • The Study Creator.

This may also involve transferring your personal information to and/or from countries located outside of the USA (e.g., EU) and vice versa. However, we can assure you that our data hosting service providers take great care to ensure any transfers are carried out securely and in compliance with all applicable data protection and data privacy legal requirements. We can also assure you that any other sub-contractors involved are also required to abide by the same data privacy legal requirements and security arrangements.

Privacy for minors 12 years old and younger

truthlab does not allow minors 12 years old and younger to participate in studies.  Truthlab will delete any results of a minor upon knowledge of such participation and results.

Privacy for minors 13 and older

truthlab firmly believes in maintaining the security and confidentiality of all visitors to its web site and studies using the truthlab platform, regardless of age. truthlab’s Customers may request that a parent or legal guardian allow one or more of their Minors ages 13 – 17 (“Minor(s)”) to respond to studies specifically designed for Minors administered through truthlab’s platform by providing a URL to the applicable study. Minors may only respond to such studies by using the URL provided, with the prior consent of a parent or legal guardian. Studies specifically designed for Minors, shall relate to products and services that are age appropriate and shall collect general demographic information about the respondent, which for example, may include the Minor’s age, gender and zip code (or larger geographic area) where the Minor resides. Such studies shall not collect more information about the Minor than is reasonably necessary for the purpose of the study, or otherwise for marketing research purposes. The Minor’s study responses shall be used for the same purposes and shall be subject to the same obligations, restrictions and conditions as any other similarly-situated study response. By providing a URL to the applicable study to any Minor, the parent or legal guardian (as applicable) has consented to such Minor’s participation in and response to studies through the truthlab platform. In the event a parent has a reason to believe that their Minor is participating in a study administered via the truthlab platform without authorization, has provided false information through a study, or wishes to exercise any of the parental rights set forth in this section, such parent may contact truthlab at 444 El Camino Real, Lower Level, San Mateo, CA 94402 (916) 5310616 or by email at legal@truthlab.com.

Communications you may receive

Service-related announcements
